How should I terminate my employment in France?

From my previous post I wrote to my accountant asking to prepare the necessary papers to terminate my employment in my husbands French business with a rupture convetionnelle. Because RSA (now Prime d’activité) have changed the rules and stopped our benefit payments, because my husband has an employee, which is me.

My accountant replied, saying there is no advantage in terminating my employment with a rupture convetionnelle, as there would be charges and the process would take two months to complete. My accountant, has not said exactly how much it would cost. They advised, I must write a resignation letter to end my employment. Stating I would not be able to get any help from pole employ or RSA / Prime d’activité, but this process would only take two weeks and by the end of 2016, I would not be part of the workforce.

Do I take the advice of the accountant and resign or insist on ending my employment with a rupture convetionnelle?

The only advantage if resigning would be:

  • Not having to pay the extra cost, but I am only employed for a couple of hours a week, so this would not amount to much.
  • I could set myself up as an auto-entrepreneur for 1 January 2017, but then I would not get any help from aide à la création ou à la reprise d’entreprise (ACCRE).

It seems like there is no easy solution. It was my accountants idea for my husband to employ me, but I am not convinced it is the right solution for our circumstances. I don’t think my accountant is happy with my decision to end my employment in my husbands business.
