What is the best way to set up a burger van business in France?

I would really appreciate some help regarding a project of setting up a burger van. Currently my partner, we’re not married, runs a SARL business in France which is going to be liquidated in the near future with a risk of him having a debt left to pay once the business is closed. We are very interested in starting up a burger / chip van business in the near future together. We would not need to take a loan out to buy the trailer.

Which is the best way to set up the business micro, auto-entrepreneur etc. and why?
What are the necessary procedures?
If I set up the business in my name, can my partner still run it with me even though he is not on any of the paperwork and without taking a salary?
Is it a possibility to set it up in both our names?
